This edition has been extensively revised to include new chapters on international legal instruments; new water regulation instruments, including the 2016 National Water Framework Bill and the 2016 Model Law on Groundwater (Sustainable Management); and new water-related instruments in areas as diverse as criminal law, land acquisition law and rural labour law. The chapters on drinking water supply, environmental dimensions of water protection, water infrastructure for irrigation and flood protection, groundwater regulation and water-dealing institutions have been fully updated to cover water legislation more comprehensively. Water regulation is of paramount importance, as water is at the heart of all aspects of life. This includes providing sufficient and safe groundwater for all, which has not yet been fully achieved. Water is also essential to livelihoods, especially agriculture, which is by far the most important sector in terms of individual livelihoods. At the same time, it must be regulated in such a way as to prioritise its protection and conservation, both in the short and long term, in order to ensure the sustainability of human use. This poses a huge challenge in a context where water regulation is largely oriented either towards state domination as an actor controlling all water for “public purposes” or towards individual landowners who have full control over the groundwater beneath their lands, even at the expense of similar use by other landowners. First published in 2011, Water Law in India is the only book that provides a comprehensive overview of legal instruments related to water in India. It presents a variety of instruments at national and state level that constitute the complex and diverse field of water law and policy. This book fills a critical gap in the study of water law and provides a rich reference point for the full range of legal mechanisms available in India.
