Is It Legal for Maintenance to Enter Your Apartment

Part of this Agreement protects your privacy as described in the laws of your state. For example, California law states that a landlord must provide written notice before entering your property. If they don`t, they`re violating your lease, either verbally or in writing. Most law enforcement officials are ignorant when it comes to landlord and tenant laws. Instead of researching the law, it`s easier for them to simply dismiss it as a civil matter. We have a landlord who has entered people`s rented properties (without emergency situations and without notice to the tenant) and if the tenant yells at him to leave his property, he refuses to leave until the police are called. The police come and do nothing and claim that he has the right to be on his own property, which he does not have. He waived this right when the tenant rented a property. We had a persistent problem in our built housing park while the owner intentionally ploughed all the snow on the pavement in the driveways of me and my neighbor just to disturb us. Employees drive at high speed, in the opposite lane, downhill and in a blind curve during ploughing. We are very worried that he will hurt someone, but when it was reported to the local police, they claimed his private property and there is nothing they can do.

This is not a gated community, anyone can drive/go to the park. I wonder why the police refuse to warn him of this behaviour. The third category allows an owner or manager to enter the premises “when the tenant has left or abandoned the premises”. Failure to do so violates the “habitability guarantee,” which allows the tenant to move, repair, and deduct or withhold rent as a remedy. You can use this law to lure them, deduct the cost of your rent [see Repairs] and have the additional barrier to their illegal entry. You can sue the owner and anyone else with their permission. While most of these officers do not have the authority to arrest anyone or suddenly enter your home (i.e. without notice), they can report to your unit fairly quickly if there is a suspicion of burglary, theft, burglary or similar criminal activity. However, emergency maintenance situations have different rules. If a fire breaks out or water leaks from one floor to another, a maintenance employee may be on site without notice.
